Cleveland: W. 101 homicide victim identified

CLEVELAND --Cuyahoga County Medical Examiner's Office released  the name of a homicide victim.

Thirty-year- old Brandon Walker of Cleveland was killed Tuesday morning on the city's west side.

The incident happened on the second floor of a home in the 2200 block of West 101st Street at about 3 a.m. Cleveland EMS crews responded to a reported assault on a woman, but found a dead man at the scene.

Police say a boyfriend and girlfriend got into a physical fight and during the fight, the girlfriend's brother, Adam Szajko, 21, got involved.

Szajko put the boyfriend in a choke hold, police said. When police arrived, the boyfriend was dead.

Officers arrested Szajko at the scene.

The girlfriend from the fight was taken to Fairview Hospital. Her condition is not available.

The official cause of death is under investigation by the Cuyahoga County Medical Examiner's Office.

Downtown Cleveland Crime: Reality vs. perception

CLEVELAND -- Cleveland's image takes a lot of abuse.

A Forbes article named Cleveland the ninth "Most Dangerous City" in the nation.

It's a black mark which may not be accurate, especially when it comes to crime in downtown Cleveland.

Despite major efforts to make downtown safer, it's not uncommon to find people who avoid downtown because of safety concerns.

Carolyn Smilor has avoided the area for the past 20 years. She used to work downtown but an encounter on a bus pushed her over the edge. "A mentally ill person sat down and licked my face. That was it for me," says Smilor.

Forbes based it's "Most Dangerous" ranking on an FBI database that collects violent crime statistics from across the county.

The Forbes ranking is based on the number of crimes. It does not take other factors into consideration, such as per capital crime, age of the city, demographics or size. 

"It's cautioned all over our website saying, please don't use this as a ranking system," says Special Agent Vicki Anderson with the Cleveland FBI office.

The Forbes article also includes the following warning:

To construct the list, we ranked U.S. cities with a population over 200,000 according to their violent crime rate as reported by the FBI's Uniform Crime Reports database. These preliminary 2011 statistics come with more caveats than the black-box warning on a dangerous chemotherapy agent, and the FBI says they shouldn't be used to compare one city with another. Differences in police reporting standards, urban borders and economics can make it tricky to compare densely populated Detroit, say, with sprawling Houston. We used cities instead of larger metropolitan statistical areas, which gave the disadvantage to older cities with tighter boundaries."

Under The Freedom of Information Act WKYC obtained a list of all crimes reported in to the Cleveland Police Department in 2012.  We mapped out the crimes and found a fraction of violent crimes occurred downtown.  Violent crimes include rape, murder, robbery and felonious assault.

  • Out of 92 homicides in Cleveland 1 was downtown.
  • Out of 535 rapes in Cleveland 16 were downtown.
  • Out of 3,129 robberies in Cleveland 130 were downtown.
  • Out of 2,180 felonious assaults in Cleveland 91 were downtown.

Downtown is home to Cleveland's most well known attractions and landmarks: Playhouse Square, Cleveland Horseshoe Casino, East 4th Street, The Rock & Roll Hall of Fame, Quicken Loans Arena, Progressive Field, FirstEnergy Stadium, The House of Blues and The Warehouse District.

The list goes on, including clubs and restaurants, some of which are owned by internationally known chefs.

Dan Rogan is a bartender at Lola on East 4th Street.

 "This place used to be a bunch of wig shops, sleazy bars and crack heads to be honest with you," says Rogan.

Over 15 years, he's seen downtown transform. "Probably right now it's the safest it's ever been. It's got lots of lights, lots of foot traffic, lots of cops."

Cleveland has crime but efforts are showing results when it comes making downtown safer for tourists and residents.

In 2012, the Cleveland Police Department nearly doubled the size of the downtown police unit to 49 officers. Their job is to focus solely on downtown.

"Come on downtown. It's safe," says Sergeant George Peters, a lifelong Clevelander.

Sgt. Peters says the department is cracking down on aggressive panhandling and officers are trained in how to deal with mental health issues and resources for the homeless.

However, crimes of opportunity are a continuous problem. Sgt. Peters says purses, computes and other valuables left in cars result in break-ins. The city launched the campaign "Put Your Junk in Your Trunk" to combat the problem.

The Downtown Cleveland Alliance is also working to make downtown safer.

The DCA has more than 60 Clean & Safe Ambassadors. Dressed in blue jackets, the ambassadors are on duty 20 hours a day, 365 days a year. The ambassadors carry radios and are in direct contact with law enforcement.

The DCA also hires an off-duty police officer to patrol E. 4th Street and Euclid Avenue during evening hours.

Downtown should not be painted as crime-free. Visitors can be targeted or caught in the wrong place at the wrong time. 

As in any city, taking precautions such as staying in well-lit and well-traveled areas brings down the chances of becoming a victim.

To test the safety of the streets, this reporter spent several evenings standing downtown alone. I was recorded by a photographer who was either in a building across the street or down the street concealed in a car. We wanted a realistic account of what would happen to a woman alone downtown.

Over the course of several evenings, I was approached by a number of homeless. I said no to every request for money. The people I talked to were never intimidating or aggressive. 

Cleveland does have crime. The city is divided into 5 districts.  We broke down violent crimes in each district.

Channel 3 Exclusive: Parmertor parents remember son Danny

It's been one year since Dina and Bob Parmertor's 16-year-old son, Danny, was shot and killed at Chardon High School.

However, for the Parmertors, the memory is as fresh as ever.

"We relive that day everyday," says Bob.

"When you say a year," says Dina. "I know that's the timeframe, [but it] doesn't feel that way for me."

The Parmertors say they have found comfort in reaching out to the families of Russell King and Demetrius Hewlin, both killed in the Chardon shooting.

"Just sometimes to call and say, 'How's your day going?'," says Dina. "We've gotten together, all of us, just talked and you find things that maybe you were thinking was only in your mind, at least I have found, same thing. They put it in the same wording. Nobody can really understand."

Last summer, the Parmertors also began going to Cornerstone of Hope, a center in Independence that helps people grieve the loss of a loved one.

"Everybody does it different and [has a] different journey, and that's something we learned. And that's OK, that everyone can feel it a different way."

For now, the journey continues, day by day, memory by memory.

"I think the closure part, they'll never be closure for us, ever. The journey, without Danny, we know we have to go through life without him. It's very difficult. But we know we have to do it. We have to, have to continue living, but closure, we'll never have it," says Bob.

"I will never close the door on my son," adds Dina.

Cleveland City Council considers energy drink ban

CLEVELAND -- An ordinance proposed by Cleveland City Council Monday night would ban minors from buying energy drinks within the city.

If passed, the emergency ordinance would not allow energy drinks to be sold to anyone under 18 and would remove them from certain vending machines.

The measure has yet to be voted on by city council.

TJ Lane expected to plead in Chardon school shooting

CHARDON --- As Chardon prepares to mark 1-year since a deadly shooting at the high school, it has been confirmed that the accused teenage gunman intends to plead guilty at a hearing today.

T.J. Lane is charged in the deaths of three students and the wounding of three others in a shooting inside the Chardon cafeteria on Feb. 27, 2012.

Even attorneys can't say whether the 1-year mark played a role in Lane's decision to plead guilty to all charges.

Geauga County Common Pleas Judge David Fuhry postponed Lane's trial from January and re-set tomorrow's court date as a status hearing to set a new date.

Now instead, the two sides will meet in court to allow a court-ordered psychiatric exam to be admitted into evidence. Lane has pleaded not guilty by reason of insanity and has been diagnosed as schizophrenic.

The two sides are then expected to meet behind closed doors after which Lane is expected to plead guilty to three counts of aggravated murder, two counts of attempted aggravated murder and one count of felonious assault.

Lane, now 18, was 17 at the time of the shootings. He is being tried as an adult but will not face the possibility of the death penalty.

At the very least, the judge could sentence him to 23 years to life in prison. If they ran the sentences concurrent that would make him eligible for parole when he turns 41 years old. The maximum penalty is life in prison without the possibility of parole.

The judge does not plan to sentence Lane Tuesday. That will come at a later date. Some of the families are said to be preparing impact statements for that sentencing date.

Now Hiring: Legit work-from-home jobs

CLEVELAND -- Today we tackle the messy but truly rewarding realm of "work from home jobs."

Whether it's folks growing increasingly frustrated with commute times or increasing gas costs, there are many reasons a work-from-home job is appealing. The problem is that there are more fake jobs out there than real ones.

Before I flag two local companies where you may be able to find that opportunity, I want to point out the scams to avoid at all costs.

• That woman you see in the ad making $8,000 per week working from home is bogus. That does not exist. Rule out any opportunities like that.

• You cannot make $3 to $5 per envelope that you stuff. Legit companies have postage machines.

• Spending $150 on a starter kit is a bad way to start. You do not need to buy your own supplies from legit companies.

• Posting ads or spam does not guarantee you rapid cash and in most cases, companies only pay you a referral fee if someone responds to an ad you post.

• You should not have to pay any fees to apply or for training. At most, a $50 background check is reasonable for some companies.

• No company can guarantee employment. Anyone that says you'll be 100% accepted if you apply is a hoax.

• All of those "featured on TV" work-from-home ads and websites are generally bogus.

Pope changes conclave rules, allows earlier start

VATICAN CITY  -- Pope Benedict XVI has changed the rules of the conclave that will elect his successor, allowing cardinals to move up the start date if all of them arrive in Rome before the usual 15-day transition between pontificates.

Benedict signed a legal document, issued Monday, with some line-by-line changes to the 1996 Vatican law governing the election of a new pope. It is one of his last acts as pope before resigning Thursday.

The date of the conclave's start is important because Holy Week begins March 24, with Easter Sunday March 31. In order to have a new pope in place for the church's most solemn liturgical period, he would need to be installed by Sunday, March 17 - a tight timeframe if a conclave were to start March 15.

Chardon one year later: Danny Parmertor Memorial Fund

CHARDON -- Saturday evening, a sold out crowd helped raise money for a great cause- the Danny Parmertor Memorial Fundraiser.

Danny Parmertor was one of three Chardon High School students shot and killed last February 27th. He was just 16 years old.

His family has now started a memorial fund in his name, so that his dream can live on in others.

Danny's aunt, Bonnie Parmertor remembers, "He was definitely our tech guy. Any time anything went wrong, he would fix it. So we miss that, we need him for that. It's like -- the computer is screwed up! Danny's not here to fix it now, so that makes it difficult."

Danny was known as Mr. Fix It and Mr. Funny -- he loved to make people laugh.

And it's with that spirit that the Parmertor family created the Danny Parmertor Memorial Fund.

It's a fund that provides scholarships for students from Chardon High School or Auburn Career Center interested in pursuing a career in computers.

Danny's mom, Dina, says through this cause, her son's memory will live on, "You don't want to forget and this is one way to share him with everybody."

But the journey hasn't been easy.

Bonnie says, "Being able just to talk about it without crying every time we talk to a new business about donating."

But the Parmertors have found comfort in their new purpose, and comfort in knowing that other students will have the chance to follow their passion.

Bonnie shares, "We've been getting together as a family and talking about Danny and it's very healing. The whole process has been healing for us."

And this year holds special meaning, since they'll be handing out scholarships the year Danny was supposed to graduate.

While Saturday's fundraiser was sold out, you can still donate to the Danny Parmertor Memorial Fund.

All proceeds will benefit student scholarships.

Lake County: 400 lose jobs as company shuts down

PAINESVILLE -- 400 people at one of Painesville's largest employers were notified of layoffs Friday.

Core Systems, LLC is shutting down productions after 50 years in the manufacturing industry.

The company makes custom molded parts in the appliance industry for clients including GE, Whirlpool, Bosch and Electrolux.

Core Systems President Bill Loebbaka says the lender gave the order to stop production late Thursday night.

"It's amazing how quickly a company can die," Loebbaka says. "In 45 minutes, my employees were gone. I kept telling them none of them did anything wrong. They did a good job. They delivered their parts on time."

After several years of growth in Painesville, Loebbaka says two weeks ago Whirlpool decided to take its business elsewhere.

"The irony is, we were in the Wall Street Journal a year ago with Whirlpool talking about bringing jobs back to America," Loebbaka says.

He says their other big client, GE, was willing to step up to make up the difference in cash flow and work force support, but the bank wouldn't wait for that to happen and gave the order to liquidate.

"I think when you're playing with people's lives, you give them a little bit more patience."

Between its large plant in Painesville and smaller plant in Mount Gilead, approximately 400 people have lost their jobs.

Many had decades of service with the company.

A handful stayed late on Friday night to help remove inventory and final customer orders.

"One by one corporations in this country are done. I'm sick of it," said Gordon Van Hyning, a tool supervisor who has been with Core Systems for seven years. "Tonight I have to go home and tell my wife I don't have a job. Not good. I have kids."

Painesville City Manager Doug Lewis says the Core Systems closing will have tremendous impact on the local economy. 

In addition to property taxes, the company brought in about $10 million in payroll on an annual basis.

Lewis says the Department of Children and Family Services is helping those laid off look for work in the local economy.

Cleveland police officers save man from burning car

CLEVELAND -- Patrol Officers Bonnie Simmerly and Elaina Ciacchi were working night shift in the Fifth District on Thursday when they received a call from radio for a suspicious vehicle.

When they arrived on Haldale, they saw a vehicle in the middle of the street.

The officers approached the vehicle and saw a man sleeping inside. They knocked on the window, at which point the man woke up, put the car in gear and sped away.

The two officers toured the area for the vehicle and located it just a short time later. The vehicle had driven off of the roadway and into a wooded area near Endora and Hillsboro.

The vehicle was on its side amongst the trees and the officers could see sparks and smoke coming from underneath the car and flames from the hood.

Officers notified radio dispatch that the car was on fire and then quickly began to strike the vehicle's rear window with their batons in order to free the man inside.

Officers were able to get the man out of the car through a window and drag him to the roadway, safely away from the vehicle.

Cleveland Fire responded to douse the burning vehicle.

The driver was taken to MetroHealth Medical Center by EMS for treatment. He was also cited for driving under suspension and failure to control.

Investigator: Glitches with traffic cameras raise red flags

CLEVELAND -- Only three of the city's 40 most dangerous intersections have cameras that ticket drivers running a red light, calling into question claims by the city that its program is designed to increase public safety, a Channel 3 News investigation found.

The station also found that four of Cleveland's five most-dangerous intersections have gotten worse since the city first installed traffic enforcement cameras in last 2005, according to an analysis of traffic data by the Northeast Ohio Areawide Coordinating Agency.

The findings come as Mayor Frank Jackson is planning to expand the city's traffic camera program, which snaps photos of cars running red lights and speeding down straight-aways and can result in tickets for the drivers.

While such programs have been around for years, some big cities, like Los Angeles and San Diego, have shut down their cameras after finding little evidence that they improve driver awareness or curb accidents.

Meanwhile, Baltimore has appointed a task force to review its program after The Baltimore Sun newspaper uncovered numerous problems, including malfunctioning cameras and poor record keeping.

Baltimore, like Cleveland, has a contract with the photocopier company Xerox to operate its traffic-camera program.

So what are city auditors saying about Xerox's performance in Cleveland?

Not a thing.

Cleveland officials said that the auditor has never looked at the program -- not at its books, not at its performance, and not at claims that cameras increase public safety.

"I don't know how you come back to council and ask us to expand this program, which they have done, without being able to show us clear evidence that the program is working," said City Councilman Zach Reed.

Erica Creech, spokeswoman for the Department of Public Safety, declined to have a city official sit for an interview, citing the ongoing contract proposal process. But she said the Bureau of Traffic routinely reviews the program, looking at daily maintenance and calibration of the cameras.

Channel 3 News decided to do what city auditors won't -- reviewing three years worth of records on the traffic-enforcement cameras.  

The Investigator Tom Meyer found that revenue from camera tickets is falling dramatically -- from more than $8 million a year in 2009 to just under $6 million last year. Xerox, though, is still getting paid its $3.25 million-a-year fee.

Xerox, in its annual report, cites road construction and better driving habits for the drop in tickets being issued.

But the station uncovered another possibility -- Cleveland Police are approving far fewer tickets. 

Police review potential violations identified by Xerox to make sure the driver actually broke the law. Records show that the percentage of those potential violations being approved have dropped over the last three years, from 86 percent in December 2009 to just 55 percent last December.

"That's a dramatic drop," said Reed. "We need to evaluate and there needs to be some type of oversight."

As for the claim that cameras prevent accidents and improve public safety? The city said it doesn't have any evidence to back it up. 

"If you're taking people's money for it, there should be some paper trail," said Courtney Nestor, who was recently sent a red-light camera ticket in the mail. "There should be credibility."

Instead, the station relied on data compiled by the Northeast Ohio Areawide Coordinating Agency, or NOACA, which conducts transportation studies for regional planning.

NOACA ranks the region's most dangerous intersections based on a composite score that takes into account the number, frequency and severity of crashes.   

Cleveland has 40 of the region's 100 most-dangerous intersections, according to NOACA's 2011 rankings.

Based on the intersections composite scores from 2005 to 2009, we found:

  • Only three of the city's 30 red-light cameras are located at Cleveland's most dangerous intersections, based on NOACA's 2011 rankings.
  • Two of the three intersections became safer. They are at East 116th Street and Shaker Boulevard, and East 55th Street and Carnegie Avenue.
  • The third intersection with the camera, at East 131st Street and Harvard Avenue, got more dangerous.
  • Four of the Cleveland's five most dangerous intersections got worse, and none have a camera. They are at East 55th Street and Woodland Avenue; Ontario Street and Carnegie Avenue near Progressive Field; East 30th Street and Orange Avenue; and East 105th Street and Chester Avenue.

There is some good news for drivers in all this. We found that 60 percent of those who appeal their ticket get it dismissed or get the fine reduced.

"I'm probably going to shoot myself in the foot because more people are going to do hearings," said Brian Mahon, one of the city's two hearing officers who conduct appeals, "but it's always to your benefit if you feel strongly about it and can present evidence."

The city said it will be asking the company that takes over the program, whether it is Xerox or another company, to do a traffic study of the intersections where the cameras will be located.

It will be too late for Reed. The councilman said he would not support  any plan that would add more cameras to the program until the city can provide evidence that it improves public safety.

"It's got to be about public safety," Reed said. "If we're putting them in locations just because we know we're going to catch people speeding or we know we're going to catch people running a red light, ...then you're defeating the purpose."

Gas nearing $4/gal; See lowest gas prices near you

Gas prices have risen for 32 days straight, according to AAA.

Northeast Ohio gas prices have jumped 52.5 cents a gallon since mid-January and are expected to keep climbing. 

The national average has increased 42.2 cents per gallon during the last month.  That's more than 13% in just over a month.

The average price of a gallon of gas in Cleveland rose 12.3 cents in the past week, averaging $3.81 That compares with the national average at $3.71.

One of the reasons for the increase is due to oil refineries switching over to the more expensive summer blend.  The Energy Information Administration also says oil companies are anticipating higher demand, since consumer confidence is higher and the housing market is rebounding.

The lowest gas prices we found Monday were:

  • $3.69 at Ravenna Oil on E. Lake Street and S. Chestnut Street in Ravenna
  • $3.79 at Circle K at Wooster Road W at 31st Street NW in Barberton
  • $3.66 at Gas Express on Clark Avenue and West 38th Street in Cleveland
  • $3.74 at Marathon on East Washington Street near Auburn Lakes Drive in Auburn
  • $3.79 at GetGo on Detroit Avenue at Bunts Road in Lakewood

Gas prices in Cleveland are 36.6 cents per gallon higher than the same day one year ago.

The rising prices reflect double-digit increases in wholesale prices with fuel production tightening in the majority of the country's refineries.

See The Possible: Kiss My Akron

AKRON, Ohio -- There's a new catch phase being used in Akron this month, that will make you take notice, and it is allowing residents and visitors to "See The Possible" in exploring downtown.

"Kiss My Akron."

It is a racy name, but it's all about spreading the love.

"The message behind it is really to share the love and to show affection and appreciation for our businesses," said Sharon Gillberg, from Downtown Akron Partnership. "It's an opportunity to take a little window cling, go downtown to their favorite businesses and destination and show a little love. And put a little kiss on their window or door."

With every peck, smack and smooch, awareness for downtown Akron is growing and businesses are enjoying each kiss.

"I love it because it brings awareness to The Peanut Shoppe," said Marge Klien, from The Peanut Shoppe. "It's hard to get people to come out in the cold weather. So, it's a great idea."

"It's a great experience to bring everybody in the community together and bring awareness that maybe everybody should be a little nicer to one another," said Shana Gyure, from The Lockview.

"Anything to promote Akron I'm all for, I mean, I think it's fun because it's a catchy phase obviously, 'kiss my Akron.' The customers have enjoyed it so far," said Mike Pickett, from Barley House. 

"Kiss My Akron" is already a success with the amount of businesses handing out window clings doubling within a week.

"There's a lot of hidden gems downtown that many people don't know about, so we are hoping that it generates awareness of some of our local treasures. There's a lot of love to share. We'll spread it around," Gillberg said.

West Side Market reopens after fire

CLEVELAND  --  Cleveland's historic West Side Market has reopened nearly three weeks after a fire covered the inside with soot.

The 100-year-old landmark near downtown has been closed since a fire broke out in one of the stalls Jan. 30.

Officials said some vendors might not be operating in full swing as the market reopens Monday because they are still replacing food that had to be thrown out after the fire.

The city fire department hasn't released its report on what caused the blaze, but foul play wasn't suspected.

Country singer Mindy McCready dead at 37

HEBER SPRINGS, Ark. -- Arkansas authorities say that country singer Mindy McCready was found dead with an apparent self-inflicted gunshot wound.

A news release from the Cleburne County Sheriff's Office says that McCready, 37, was found dead Sunday afternoon with what appears to be a single, self-inflicted wound. She was found on the front porch of a home.

McCready hit the top of the country charts before personal problems sidetracked her career

In 1996, her "Guys Do It All the Time" hit No. 1 and its dig at male chauvinism endeared her to females.

Portage Lakes Polar Bear Jump brings out brave bunch

PORTAGE LAKES -- Pirates, ninjas and superheroes were among the wacky pack of people jumping into wickedly cold waters in the 10th annual Portage Lakes Polar Bear Jump.

With flurries flying and ice floating, hundreds of people packed the beach at Portage Lakes State Park on Saturday to take the bone-chilling challenge in an effort to raise money for the Akron-Canton Regional Foodbank.

Officials with the event say it was a splashing success with more than $75,000 raised.

Each brave jumper raised/donated at least $25 to take part in the plunge.

The 2013 event started with Akron-Canton Regional Foodbank CEO Dan Flowers making the first jump with his son around 2 p.m.

From that point forward, hundreds of people -- some in simple swimwear, others in goofy getups -- put their toes on the edge of the dock and lunged into the choppy water.

Some then swam to a nearby ladder to get out of the water as quickly as possible, while others raced to shore where a large audience of warmly dressed folks watched it all unfold.

Emergency crews were on hand to make sure everybody was safe and warming tents were available.

The total number of participants and a final tally of money raised will be calculated Sunday.

Atty: Negotiations for plea deal in TJ Lane case underway

CHARDON -- Attorney Ian Friedman says negotiations are underway for TJ Lane to plead guilty in the Chardon High School shooting case.

Friedman said the intention of the defense is to sign that agreement on February 26. That is the next scheduled hearing in the case and one day before the one-year anniversary of the shootings.

Three students weer killed and three wounded that day.

Geauga County Common Pleas Court Judge David Fuhry already set 9:30 a.m. Feb. 26 for a hearing to set a new trial date for suspected Chardon school shooter TJ Lane.

Lane, then 17, was originally scheduled for trial on Nov. 26, 2012, but that date was continued to Jan. 14, then that date was continued.

Fuhry also previously denied earlier change of venue requests by defense attorneys. He said he could decide later to allow a change of venue if a jury can't be seated.

Voir dire for jury selection was originally set to begin Feb. 4 but Fuhry cancelled that. "Voir dire" is a process by which prospective jurors are questioned about their backgrounds and potential biases before being chosen to sit on a jury.

Fuhry said he thinks an impartial jury can be seated in Chardon and wanted to voir dire the jury before he would even reconsider his previous denial of a change of venue in the case.

Chardon police say Lane entered the cafeteria and opened fire, killing Russell King, Jr., 17, Daniel Parmertor, 16, and Demetrius Hewlin, 16 and wounding Nick Walczak, 17, Joy Rickers, 18 and grazing the ear with a bullet of a sixth person.

Lane faces life in prison if convicted of the multiple counts of aggravated murder because he was 17 when the shootings occured.

He has pleaded not guilty by reason of insanity.

Exclusive: Westlake moviegoer with gun speaks out

WESTLAKE -- For the first time, we are hearing from the local man who brought a gun and weapons into a Westlake movie theater, just days after the deadly shooting inside a Colorado movie theater.

Scott Smith regrets his decision to take a loaded gun into the Regal theaters in Westlake.

He says the community has nothing to fear from him, that he was protecting himself.

"I was being stubborn and I wasn't about to let James Holmes and people like him dictate my behavior," Smith said.

Instead, Scott Smith, 38, fell right into the same trap he was trying to avoid. His life has changed forever, now facing a possible prison sentence.

"It's in a shambles, Smith said.

Last August, Smith packed a loaded gun, ammo and a knife into a duffle bag and headed to Regal Cinema in Westlake for the new Batman film "Dark Knight Rises."

"I didn't think it was this big of a deal," Smith said.

Smith wanted to see the film but not take chances. Three movie house shootings nationwide, including the Colorado ambush that killed 12 people, left him on the defensive.

"I made a snap decision. A poor decision. I didn't think it through," Smith said.

He was charged with 20 felony gun violations, including posession under disability because he took a sleeping aid and pain medication.

"There were implications for the entire country and everyone who owns guns and takes medications, so I felt like I had to fight it out," Smith said.

He fought it and won. The judge dropped the charge Friday. He pleaded guilty to two counts of carrying concealed weapons. While he regrets his decision, Smith can't help but feel there is another agenda at work here.

"This became about politics and gun control," Smith said.

Smith says having to do it all again, he simply would have stayed home.

When asked why he didn't get a conceal carry permit, Smith says he had no time to do it, that he thought this was the one and only time he needed to carry a gun.

Raw video: Russia meteor strike injures hundreds

MOSCOW -- A meteor streaked across the sky above Russia's Ural Mountains on Friday morning, causing sharp explosions and injuring more than 400 people, many of them hurt by broken glass.

Fragments of the meteor fell in a thinly populated area of the Chelyabinsk region, the Emergency Ministry said in a statement.

Interior Ministry spokesman Vadim Kolesnikov said more than 400 people had sought medical treatment after the blasts, and at least three had been hospitalized in serious condition. Many of the injuries were from glass broken by the explosions.

Some of those injuries were reportedly at a school in a thinly populated part of the region, which is on the eastern edge of the Ural Mountains.

Part 2: What's life like with no daily paper?

ANN ARBOR -- Channel 3 news went to Ann Arbor, Michigan to see how that community has adapted to life without a daily newspaper.

The city was the test for a business model similar to one used at other Advance-owned papers in New Orleans, Harrisburg, Syracuse and other cities in Alabama and Michican.

The Ann Arbor News ended publication in 2009 after 174 years of daily service. More resouces have been poured into a website, AnnArbor.com, that also publishes a twice-a-week paper.

Some believe similar changes could be in store for the Plain Dealer. Big staff cuts and reassignments are coming there in May.

To learn how the model has worked in Ann Arbor, Channel 3 made multiple calls and e-mails to several key players. None was returned.

Advance Digital's Steve Newhouse could have arranged for personnel in Ann Arbor to be part of our coverage, but chose not to.

WKYC Reporter Tom Beres was greeted by a pair of security guards at the AnnArbor.com office building, who said they'd been hired for the specific purpose of keeping him out of the building .

One said, "We were told you cannot enter the building and, if need be, will escort you off the premises and, if there are problems, we'll call the police,"

In previous print articles, Newhouse has bragged the Ann Arbor website consistently ranks highest in the country for local penetration -- almost 55 percent -- and won 21 journalism awards.

Mary Morgan oversaw the old paper's editorial page. She left before the shutdown. Now she's the publisher of a competing website, the Ann Arbor Chronicle.

She says AnnArbor.com is no longer a vigilant watchdog.

"They have a far smaller staff. There's an emphasis on sensationalism...Decisions are being made on how one particular market fits into the overall picture. It's not looking at what's best for the individual community,"  she said.

Chronicle Editor Dave Askins says the changeover has created opportunities for other media outlets, but created a psychological loss.

"You know, I've finished my civic task for today...how do I know? ..I read the newspaper...you're never done with the internet," he said.

But Chamber of Commerce President Diane Keller says the website is more suited to the faster speed of business.

"You are given the Cliff Notes version ASAP...the articles aren't as long and are more concise but updated more often...the newspaper industry needed to change," she said.

Many Ann Arbor News employees lost jobs. Some found other media jobs in the community in public relations.

Ann Arbor's longtime mayor John Hieftje says the new website is getting better.

"The online presence of annarbor.com has improved...the people who cover the city are better than those who used to," he said.

And while Advance and the new website declined to cooperate with our coverage, there is still no timetable or definitive information about what are changes are coming and when at the Plain Dealer, according to publisher Terry Egger.

Part 1: What's life like with no daily paper?

ANN ARBOR -- It's old news that Ann Arbor, Michigan no longer has a daily newspaper.

In July, 2009, The Ann Arbor News stopped publishing every day after 174 years and lots of history. It was one of the first papers to oppose slavery.

It's been replaced by AnnArbor.com, a high-energy website that publishes a companion newspaper just two days a week.

Both the old paper and new media organization were or are owned by the same business group that owns the Plain Dealer.

Channel 3 News went to Ann Arbor to get an idea how the community has adapted to having no daily paper.

Big changes are coming soon at the Plain Dealer. The business model introduced in Ann Arbor is similar to that adopted at other Advance papers.

Ann Arbor resident Debbie Funchion said, "I like it. It's easy  access and I don't have to pay for it."

Tom Brandt is a computer-focused businessperson. He said, "The stories don't seem to be as well written and don't seem to be fact-checked as well...There is a lot more fluff."

Ann Arbor is a logical place to test a new digital media model. Much of the population is young and educated, either attending class or working at the University of Michigan.

Google has a major office there.

Veteran Mayor John Hieftje said, "Ann Arbor was one of the original hubs of the internet...If it wasn't going to work here, you sure wouldn't want to try it anywhere else."

Many businesses like the website's speed and ability to change ads right away.

Chamber of Commerce President Diane Keller said, "It's been good for the business community...They might have to wait several days to get in the newspaper. Now they can have it that day."

Older and poorer residents who are not computer users feel less connected.

Charles Yates earns money selling a newspaper for the homeless.

"People like me, I'm not too great with the computer. There's no daily paper when you are looking for jobs," he said.

No daily paper has left city government scrambling to try to fill an information void.

"We've had to really step up our game and get information to the people...We've seen a big dropoff in the ability of our population to be informed...There are some folks that just are not going to go online to get their news," Mayor Hieftje said.

Veteran councilwoman Sabra Briere sees it as the loss of a community compass.

"We've lost a shared level of awareness..It's not just a community consensus, it's a community trust...I know this (the paper) was reliable," she said.

Channel 3 sought to get information from AnnArbor.com about how it's fulfilling its role as a journalistic watchdog and how the new business model is working.

Numerous calls and e-mails seeking to set up interviews and get information were not returned.

Hours-long SWAT standoff ends peacefully

CLEVELAND -- A SWAT standoff in Cleveland Tuesday night ended with a man arrested.

Police were originally called to the area of 3400 West 120th Street for a domestic violence call. When they arrived they found the man with a gun. Family members were removed from the home and SWAT called. The man then barricaded himself inside for several hours.

Police said he surrendered just before midnight peacefully.

Police have not said what type of weapon he had or given his identity.

Cleveland firefighter injured in house fire

CLEVELAND -- A Cleveland firefighter was taken to the hospital after a fire overnight Wednesday.

Paramedics confirm the fire fighter was taken to Metro Health Medical Center with minor injuries and is in stable condition.

Crews were called to the home on Tampa Ave. about 1:45 a.m.. The home was vacant and crews were able to get the flames out quickly.

The cause of the fire is not known.

North Korea: Test was "first response" to US threats

PYONGYANG, North Korea (AP) - North Korea says its nuclear test was its "first response" to U.S. threats and warns it will continue with unspecified "second and third measures of greater intensity" if the United States maintains its hostility.

The White House is calling the test a "highly provocative act" that threatens U.S. security and international peace.

In a statement issued early Tuesday, President Barack Obama promises to "continue to take steps necessary to defend ourselves and our allies." He also urges "swift and credible action by the international community."

The North's Foreign Ministry said in a statement that its nuclear test Tuesday was a "self-defensive measure" that does not violate any international law.

The test is seen as a crucial step toward North Korea's goal of building a bomb small enough to be fitted on a missile capable of striking the United States.

North Korea's test drew immediate condemnation from Washington, the U.N. and others. Even its only major ally, China, voiced opposition.

Pope to resign Feb. 28

VATICAN CITY -- The Vatican has confirmed Pope Benedict will step down at the end of the month. His last day is set to be February 28th.

The Pope made the statement in Latin during a small canonization event saying he doesn't have the strength anymore.

Joseph Aloisius Ratzinger began his papacy in 2005.

The pontiff's statement said, "After having repeatedly examined my conscience before God, I have come to the certainty that my strengths, due to an advanced age, are no longer suited to an adequate exercise of the Petrine ministry."

Reportedly, this is only the second time the head of the Catholic church has stepped down.

Mother finds son lying in the driveway shot

CLEVELAND -- A mother finds her son shot multiple times in his driveway.

The Cleveland Police Department tells us Richard McCoy, 41, was shot to death Saturday night just before 10 p.m.

The shooting happened at 11905 Princeton Avenue. McCoy was transported to MetroHealth Medical Center before dying from his injuries.

McCoy did not tell his mother where the shooting happened or who shot him before he passed away.

Flights diverted by Noreaster may land in Cleveland

CLEVELAND -- Even though Northeast Ohio is west of the blizzard hitting the east coast, it is still affecting travelers, especially at local airports.

Cleveland might not exactly be on the itinerary for some people, but they'll find themselves visiting for the night. Cleveland Hopkins International is a "diversion" hub, meaning if a flight can't land in a city hit by the storm, they'll land in Cleveland for the night.

Some airlines canceled flights Thursday, but as the storm rolled through Friday, the departure board at Hopkins lit up with red cancellation notices in any east coast city.

Airport representatives say they don't expect too much of a travel mess in Northeast Ohio, however, people should check their flight status before heading to the airport.

Massive power outages as Northeast blizzard turns deadly

A blizzard predicted to be of epic proportions is pounding the Northeast, already bringing more than 3 feet of snow to some areas and cutting power to 650,000 homes and businesses.

More than 3 feet had fallen on central Connecticut by early Saturday, and areas of southeastern Massachusetts, Rhode Island and New Hampshire notched 2 feet or more of snow - with more falling.

The storm is being blamed on at least four deaths in New York and Canada. In New York, a 74-year-old man died after being struck by a car in Poughkeepsie; the driver said she lost control in the snowy conditions, police said.

Hurricane-force wind gusts are sweeping the Northeast, and a gust of 76 mph was recorded at Logan airport. Blizzard warnings are in effect for the New York City metro area and many coastal sections of New England.

More than 5,200 flights in the region have been canceled through Saturday, according to flight-tracking service FlightAware.

In the New York City area, John F. Kennedy Airport, LaGuardia Airport and Newark Airport were open as of 7 a.m. Saturday, according to the Port Authority of New York and New Jersey. Some commercial flights were expected to resume as early as 9 a.m., but carriers have canceled many flights. Travelers were urged to call ahead and check with their carriers for specific flight information.

The storm is now officially the sixth-greatest in Boston history, according to the National Weather Service. An official snow total from Boston's Logan Airport this morning registered 21.8 inches, which puts it in sixth place on the all-time list. Snow is still falling in Boston, so that number is likely to go up.

In New York City, the official snowfall total at Central Park is 11.4 inches. New Haven, Conn., has already seen 29.8 inches of snow and 34 inches were dumped on Hamden, Conn., according to the National Weather Service.

The highest snowfall total so far is in Milford, Conn., which has received 38 inches.

Conn. Gov. Dannel Malloy ordered all roads closed statewide early Saturday.

"It's critical right now that residents stay off the roads, so that our plows can continue their efforts to clear our streets and highways," said Malloy. "This is a record setting storm. It's going to take time to dig out of the snow. Stalled or abandoned vehicles will only slow that process. Unless you face an emergency, please stay put."

Police in New York say hundreds of cars have gotten stuck on the Long Island Expressway because of the blizzard conditions and dozens of disabled motorists are still on the road. The Long Island Expressway and Sunrise Highway are both shut down in Suffolk County except for emergency vehicles. The snow also caused a 19-car, four-hour pileup on I-295 near Cumberland, Maine. Several people had minor injuries, police said. In Vermont, which could get 4 to 16 inches of snow, the storm was being blamed for a series of crashes on I-89 in Bolton and South Burlington. Two people were taken to the hospital with minor injuries.

Connecticut, Rhode Island, New York and Massachusetts have declared states of emergencies.

Massachusetts Gov. Deval Patrick banned all traffic from roads Friday afternoon, believed to be the state's first such ban since the blizzard of 1978. Forecasters said Boston could get more than the 27.5-inch record of 2003.

Utility officials are warning customers to prepare for power outages lasting for days. New England and New York are expected to take the hardest hit, but others around the country could feel the ripple effect from canceled flights and trains and snarled traffic along the Eastern Seaboard, parts which are still reeling from the fallout of October's Superstorm Sandy.

In New Jersey, residents of Brick Township and Toms River, both crippled by Sandy, were urged to evacuate Friday.

Newark Mayor Cory Booker urged residents to prepare for widespread power failures. Booker, a prolific Twitter user, urged his nearly 1.4 million followers to get ready for the storm. "Nwk's City Snow Team is prepared for 6-12 inches," he tweeted from @corybooker a couple minutes after 5 p.m. on Thursday. "We have many snow assets in reserve should storm get worse. Please take time 2 prepare too."

New York City Mayor Michael Bloomberg said the blizzard wasn't expected to rival Sandy's fallout, but urged everyone to "stay in your homes while the worst of the storm is upon us."

He urged New Yorkers to leave work early and avoid commuting Friday evening, when meteorologists predict the snowfall to intensify.

The New York City metro area, home to three airports and 20 million residents in four states, was bracing for up to 12 inches of snow, according to AccuWeather meteorologist Alex Sosnowski.

In Boston, Mayor Thomas Menino said the city has 34,000 pounds of salt to treat icy roads. "Stay off the roads. Stay home. Let the public works crews do their jobs," Merino said.

The Pilgrim Nuclear Power Plant in Plymouth experienced an automatic shutdown at around 9:15 p.m. Friday after losing off-site power. Spokesman Neil Sheehan says that the reactor shut down without any problems and that backup generators are powering plant equipment.

The Nuclear Regulatory Commission says there's no threat to public safety.

The storm isn't expected to have a major economic impact on New England, said economist David Iaiaof Lexington, Mass.-based IHS Global Insight.

"If everything just shuts down for a day, the vast majority of business merely gets shifted to before the storm or after the storm," Iaia said.
